Under the UAE Labour Law, employees are generally required to serve a notice period before resigning. However, Article 45 of the law outlines specific circumstances where employees can resign immediately without serving notice. These exceptions include violations of employee rights by the employer, workplace assaults, serious safety or health risks at the workplace, and being forced to perform tasks outside the agreed employment contract. The Ministry of Human Resources and Emiratisation (MOHRE) must be notified in certain cases, and conditions must be met for immediate resignation.
Employees who experience a breach of their rights by the employer must notify MOHRE at least 14 days before resigning and give the employer a chance to rectify the issue. If assaulted at work, the incident must be reported to the relevant authorities and MOHRE within five working days. For serious safety or health risks, immediate resignation is allowed if the employer fails to address the issue. If forced to do a different job without consent, employees can also resign without notice.
